PINS Online Rewards Shop Terms & Conditions

1. Access to the Online Rewards

1.1 PINS Online Rewards Shop:

The PINS Online Rewards Shop (“PINS Rewards Shop”) is part of the PINS loyalty program, created and maintained by Coalition Rewards (“Program”). The use of PINS Rewards Shop is exclusively for Program members (“Member)”  who can enter into legally binding agreements under applicable law. The rules relating to the use of PINS Rewards Shop are set out below.

1.2 Acceptance of Terms and Conditions:

By accessing this PINS Rewards Shop site or any website linked to PINS Rewards Shop site (“Site”) and making transactions through PINS Rewards Shop, specifically by clicking the "I AGREE" and/or similar buttons, Member expressly indicates his/her acknowledgment and acceptance of the rules applicable to PINS Rewards Shop.

1.3 Acceptance of Electronic Communication:

If Member has opt in for acceptance of Electronic Communication - Member consents to receive communication, including reward purchase confirmation, from PINS Rewards Shop and the independent merchants electronically and agrees that such electronic communication corresponds to any legal requirements that such communication be in writing.
1.4 Redemption Types:

Member has the possibility to redeem loyalty currency PINS (“PINS”) in accordance with the following redemption types: Exchanging and Donating. For each transaction, Member needs to use at least one hundred PINS. See further below for each redemption type.

1.5 Rewards:

The rewards consist of any goods or services acquired by Member in the form of exchanging PINS, and exchanged and distributed by independent merchants that make available such rewards directly to Member via PINS Rewards Shop.

1.6 Relation between Member and Merchant:

Every time Member acquires a reward via PINS Rewards Shop, he/she directly enters into an agreement with the respective merchant. PINS Rewards Shop only provides the access and the technical platform for Member to redeem rewards directly from the merchant. Member agrees and acknowledges that separate terms and conditions of the relevant merchant will apply to any reward redemptions via the PINSRewards Shop. Member agrees to abide to such applicable terms and conditions, including but not limited to, rules and restrictions on availability, shipment and delivery terms, notification of defects, return and refund policies, money back guarantees and claim for damages of the relevant merchant. PINS Rewards Shop does not become a party to the transaction between Member and the merchant. PINS Rewards Shop strongly recommends that Member checks the terms and conditions of the merchant prior to redeeming any reward.

1.7 Use of PINS Rewards Shop:

Member may only use PINS Rewards Shop to make non-commercial, legitimate reservations or reward acquiring or benefit from other redemption types and shall not use the Site or the PINS Rewards Shop for any other purposes, including making any speculative, false or fraudulent reservations or reward acquire or other reward redemptions. Rewards on PINS Rewards Shop are subject to availability at the time Member places the order. By accessing and/or using the PINS Rewards Shop, Member authorizes PINS Rewards Shop to consider any person using his/her information as legitimate user. Rewards can be redeemed only by Member personally. Members/legal guardians must ensure that the login details are not used illegally. PINS Rewards Shop bear no responsibility for any consequences of illegal use of the personal details. Please be aware  - if Member recognizes any illegal misuse of his/her PINS , he/she is responsible for reporting about such case  to the relevat state authorities or officers. PINS Rewards Shop reserves the right to terminate membership in cases they deem constitute misuse.

1.8 Restriction on Use:

Due to local laws and regulations, PINS Rewards Shop reserve the right to exclude members from certain jurisdictions from making transactions over PINS Rewards Shop. By making transactions via PINS Rewards Shop, Member confirms that he/she is not breaching any laws in his/her country of residence regarding the legality of such use. PINS Rewards Shop will not be held responsible (i) for the exclusion of Members from certain jurisdictions and (ii) if Member uses the PINSRewards Shop unlawfully. If in any doubt Member should check with the relevant authorities in his/her country of residence.

2. Customer Service

For questions related to the products purchased in PINS Rewards Shop or to Member`s order, Member shall contact the relevant merchant. For general questions related to PINS Rewards Shop and the redemption types, please contact us.

3. Redemption Types

3.1 Buying

Through this redemption type, Member has the possibility to acquire rewards from merchants in exchange for PINS, or a combination of PINS and money. For each transaction, the use of at least five hundred PINS is mandatory. Please see 4.2. and 4.3. for further details.

3.2 Donating

Through this redemption type, Member has the possibility to redeem PINS by making donations or contributions to charitable or other institutions. Donations can only be made in PINS and no money donations can be made through PINS Rewards Shop.

4. Reward Payment

4.1 General:

When purchasing rewards via PINS Rewards Shop, Member can pay for such rewards either with PINS, or with any combination of PINS and money.

4.2 Payment with PINS:

Member may purchase a reward for such amount of PINS as indicated for each reward in PINS Rewards Shop, provided that Member has sufficient PINS available on his/her account at the time of purchase. PINS that are not yet accrued and credited to Member`s account at the time he/she places the order are not available for reward purchase. Should Member not have sufficient PINS available on his/her account at the time of the purchase, or should Member prefer to pay only part of the reward in PINS, Member may pay the difference with money (by payment card or credit card) in accordance with these terms and conditions. PINS are deducted from Member`s account as soon as a reward is purchased.

4.3 Payment by Payment Card or Credit Card:

Member may pay part of the reward price with money by credit card. We accept only EUR currency, if the payment is executed in other currency Member will borne the costs of the currency exchange rate as set by cardholder`s issuing bank.  For money payments by payment card or credit card, a secure Credit Card Internet Gateway Service (with for example SecureCodeTM/ 3-D SecureTM ) is used. The communication with the payment gateway happens via https. The amount as indicated in PINS Rewards Shop for the respective reward will be collected by PINS Rewards Shop.

4.4 Conversion Ratio:

The amount of PINS necessary for the purchase of a reward is determined by PINS Rewards Shop and PINS Rewards Shop has the right, at any time and at its sole discretion, to change the amount of PINS necessary to purchase a reward. The conversion ratio of PINS can differ from reward to reward.

4.5 Conversion into Cash:

The conversion of PINS into a cash amount and the payment of such cash amount to Member or any similar transactions are not possible, not even in case of return of the reward or services or the cancellation of Program membership.

4.6 Reclaim of PINS:

Any rewards purchased by Member with PINS that have not been properly debited to his/her account can be reclaimed by PINS Rewards Shop at any time without compensation.

5. Shipping, Handling and Return of Rewards

5.1 General:

Regarding shipping, handling, returns or other delivery related matters such terms and conditions as set out in the relevant merchant details on PINS Rewards Shop are exclusively applicable.

5.2 Shipping:

Rewards are sent only to the Member’s registered address or to such other address as explicitly provided with a specific reward order. Delivery dates cannot be guaranteed and PINS Rewards Shop assumes no liability for failed deliveries caused by incorrect addresses, absence of the recipient, customs issues, force majeure or other reasons not under reasonable control of PINS Rewards Shop. Member shall contact the merchant in case of non-delivery of the reward beyond the estimated delivery time stipulated on the order confirmation page. Any non-delivery claims received later than 3 months from order date can no longer be processed. In accordance with local customs requirements, Member may be required to provide a copy of his/her passport and the purchase invoice prior to or on the delivery date.

5.3 Fees and Taxes:

The prices on PINS Rewards Shop include all taxes and shipping and handling fees unless otherwise specified. Nevertheless, for some rewards, Member may be charged and may additionally bear local duties and taxes such as for example VAT and/or luxury taxes, etc. depending on requirements of Member`s local jurisdiction. Member is pleased to check with his/her local authorities prior to ordering a reward.

5.4 Withdrawal Period:

Where required by applicable law, our merchants give a 14-day withdrawal period dating from the day on which Member received the reward. The withdrawal period shall, however, always comprise at least 7 working days from the day on which Member received the reward. During this period, Member has the right to withdraw from the purchase by notifying the merchant and returning the unused and undamaged products in original packaging to merchant's address. If the reward is damaged or lost during its return from Member to merchant, Member is liable to pay for it. Rewards returned thereafter can no be longer considered for refund or exchange nor can the PINS be refunded unless specified otherwise.

5.5 Return Handling:

In case a merchant grants a return period that exceeds any legally required withdrawal period, such terms as set out in the relevant merchant terms and conditions in PINS Rewards Shop are exclusively applicable. In case of (i) returns in accordance with the applicable terms and conditions of the relevant merchant, or (ii) unsuccessful delivery due to Member`s actual fault (e.g., insufficient or incorrect delivery address or no physical acceptance of reward at delivery address) Member may be charged with incurred credit card fees, additional shipping and handling fees, and any other taxes and expenses in connection therewith. Member may be required to pay these charges in PINS equivalent or money, depending on the nature of the original redemption transaction.

5.6 Guarantee Period:

In case of an existing fault in a reward, such guarantee periods, if any, as set out in the relevant merchant terms and conditions in PINS Rewards Shop are exclusively applicable.

6. Personal Information

6.1 Share of Information:

The data collected through PINS Rewards Shop is governed by PINS Privacy Policy which shall be deemed to be incorporated into these Terms and Conditions. In order for PINS Rewards Shop to process any reward purchase transactions or other reward redemptions via PINS Rewards Shop, Member will have to transmit certain personal information, including his/her name, home and email address, phone number and, if paid with money, credit card information. By providing such information Member consents to PINS Rewards Shop sharing certain part of that information with third party providers as necessary to process and complete the required transaction. PINS Rewards Shop shall not be liable for any wrong personal information received or obtained from Member.

6.2 Consent to Transfer:

Member further acknowledges and agrees that by providing PINS Rewards Shop with any personal or proprietary information, directly or indirectly through PINS Rewards Shop or the Program, he/she consents to the transmission of such personal or proprietary information over international borders as necessary for processing the relevant transactions in accordance with PINS Rewards Shop Privacy Policy. Member further consents to the use of such personal data on an anonymous basis for statistical objectives.

7. Limitation of Liability

7.1 Contracting Party:

When acquiring rewards through PINS Rewards Shop, Member enters into an agreement with the relevant merchant of the product, and not with PINS Rewards Shop. Member expressly acknowledges and agrees that merchants are independent contractors and are not employees or agents of PINS Rewards Shop. PINS Rewards Shop is not liable for the acts, errors, omissions, representations, warranties or negligence of the merchants. PINS Rewards Shop shall not be responsible for or liable to Member in connection with any restrictions, qualifications, or other terms and conditions imposed by the merchant on any reward items. As far as permissible by applicable law, PINS Rewards Shop hereby disclaim any product or other liability, whether based on contract, tort, strict liability or otherwise, including without limitation liability for any direct, punitive, special, consequential, incidental or indirect damages, in connection with the rewards provided by any merchant through PINS Rewards Shop, including without limitation liability for any act, error, omission, injury, loss, accident, delay or irregularity which may be incurred through the fault, negligent or otherwise, of such merchant and Member hereby expressly exonerates PINS Rewards Shop from any liability with respect to the same. To the extent permitted by law, PINS Rewards Shop excludes all liability to Member or other person of whatsoever nature in respect of any negligence, wilful misconduct, poor service or other breach of obligation arising out of the provision or failure to provide the services by or on behalf of a merchant.

7.2 No Warranty:

PINS Rewards Shop  does not warrant or represent that the content on PINS Rewards Shop site or any website linked to PINS Rewards Shop is complete or up-to-date. PINS Rewards Shop is under no obligation to update any content on the Site. PINS Rewards Shop may change the content on or make improvement or changes of the Site at any time without notice. The information, products, and descriptions of rewards and other services published on the Site or a linked Site may include inaccuracies or typographical errors, and PINS Rewards Shop specifically disclaim any liability for such inaccuracies and errors.

7.3 Limitation of Liability:

Member agrees that PINS Rewards Shop, its affiliates and any of their respective officers, directors, employers, or agents will not be liable, whether in contract, tort, strict liability or otherwise, for any direct, punitive, special, consequential, incidental or indirect damages (including without limitation lost profits, cost of procuring substitute service or lost opportunity) arising out of or in connection with the use of the Site or PINS  Rewards Shop, or with the delay or inability to use the Site or a linked Site, even if PINS Rewards Shop is made aware of the possibility of such damages. This limitation on liability includes, but is not limited to, the transmission of any virus which may infect Member`s equipment, failure of mechanical or electronic equipment or communication lines, telephone or other interconnect problems, unauthorized access, theft, operator errors, strike or other labour problems or any force majeure. PINS Rewards Shop cannot and do not guarantee continuous, uninterrupted or secure access to the Site or PINS Rewards Shop.

7.4 Legal Remedies:

PINS Rewards Shop reserve the right to seek all remedies available at law and in equity for any misuse of the Site or PINS Rewards Shop and/or violations of these rules, including the right to block access from a particular internet address and to exclude Member from accessing the PINS Rewards Shop.

8. Copy Rights and Trade Marks

The trademarks, logos and service marks (collectively "Marks") displayed on PINS Rewards Shop are the property of Us or of the merchant as the case may be. Member is prohibited from using any Marks for any purpose including, but not limited to, the use as metatags on other pages or Sites on the World Wide Web without the written permission of PINS Rewards Shop, or such other party which may own the Marks. All information and content including any software programs available on or through the Site (collectively "Content") is protected by copyright. Member is prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on or through the Site for commercial or public purposes.

9. Confidentiality of Personal Information

Access to and use of password protected and/or secure areas of the PINSRewards Shop is restricted to authorized persons only. Unauthorized individuals attempting to access these areas of PINS Rewards Shop may be subject to prosecution. Member is responsible for maintaining the confidentiality of his/her personal information, including his/her account and password, and for restricting access to his/her computer to prevent unauthorized access to PINS Rewards Shop. Member agrees to accept responsibility for all redemption and other activities that occur under his/her account or password. Member should take all necessary steps to ensure that the password is kept confidential and secure and should inform PINS Rewards Shop immediately if he/she has any reason to believe that his/her password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorized manner.

10. Shop operator
